Prosecutor still to decide whether to file charges on Delta Tau Delta members

University continues investigation to decide on fate of fraternity

Delaware County Prosecutors Office has not yet decided whether to press charges against two Delta Tau Delta members who were arrested in connection with a theft at Theta Chi fraternity house.

Deputy Prosecutor Eric Hoffman said he had received all evidence from the theft, but he is still reviewing the case.

"I'm still considering what I'm going to do," Hoffman said.

Gene Burton, director of public safety, said in a previous interview Ball State University police arrested Dustin Koch on suspicion of theft/possession of stolen property and burglary. James Finn was arrested on suspicion of theft/possession of stolen property and minor possession/consumption of alcohol, Burton said.

According to police reports, Theta Chi reported $2,500 worth of paddles, trophies, composite photos and a fraternity flag as stolen on Nov. 27.

Burton said the following day Ball State police found the property in Finn's bedroom at Delta Tau Delta's house.

According to Delaware County Jail officials, Finn was released later that day on $6,000 bail, Koch was released on a $20,000 bond the day after.

Lynda Wiley, director of student life, said the university has met with representatives from both fraternities to determine what happened and who should be held accountable.

"Since the information from the members has been consistent with what was in the police report, at this time, those two individuals will be dealt with through the Office of Student Rights and Community Standards," Wiley said.

The university is still investigating Delta Tau Delta to determine if the fraternity should be held responsible as a whole, Wiley said.

The fraternity's international headquarters said in a press statement that it is also investigating the incident to determine what course of action it should take against the fraternity, if any. The headquarters is working with the university and the police, according to the press statement.

The headquarters would not comment further until the investigation is complete.
