Man arrested in connection with assault

Suspect turns self in for incident at Linden Place Apartments

A Fishers man remains in Delaware County Jail after being arrested Friday in connection with an assault April 6 at Linden Place Apartments, according to jail officials.

Sgt. Darrin Clark of the Muncie Police Department said Benjamin Brooks, 25, turned himself in and was arrested on probable cause.

"He turned himself in at one of the [Muncie] law offices," Clark said. "He had heard I was looking for him and he surrendered himself."

Clark said Brooks was charged with assault with a deadly weapon on suspicion of pistol-whipping Linden Place resident Anthony Lee in the head, and was charged with criminal recklessness on suspicion of firing a gun into an occupied apartment, Clark said.

Jeff Arnold, chief trial deputy for the Delaware County prosecutor's office, said he will formally file both charges, which are Class C felonies.

According to the Indiana Code, Brooks could receive between two and eight years in prison and a maximum fine of $10,000 for each charge if he is convicted. Brooks' trial date will be set at his initial hearing, Arnold said.

Delaware County Court officials said his initial hearing will be set when the charges are formally filed.

Clark said Ball State University senior Julius Williams was also arrested in connection with the incident on suspicion of disorderly conduct, a Class B misdemeanor. He was released later that morning, he said.

Former Ball State basketball player Darren Yates was brought in for questioning but was not arrested, Clark said.

Brooks, Williams and two other people got into an argument with Lee and roommate Stephen Brandon on April 6 at Dill Street Bar & Grill, Clark said. Lee and Brandon returned to their apartment, but Brooks, Williams and their friends arrived later and another fight broke out, and Brooks allegedly pistol-whipped Lee, Clark said.

The roommates went inside their apartment and Brooks allegedly fired one gunshot through the apartment's door, Clark said.

Lee was treated at Ball Memorial Hospital later that morning, Clark said.
