Public access to these documents was originally prohibited by the university, who cited Indiana Code 5-14-3 (b)(6), which states institutions may withhold certain intraagency materials.

Originally, the documents were available to students, staff and faculty of the university +â-óGé¼" what the university termed "members of the Ball State community." The Ball State Daily News, however, was prohibited from accessing or publishing the evaluations, as were those individuals not included in the community definition. Members of the Ball State community who did request access to the documents were asked to sign a form agreeing to not distribute the information publicly.

In October, the Daily News challenged the university's opinion by filing a formal complaint with Indiana's Public Access Counselor Karen Davis.

In a Nov. 10 advisory opinion, Davis said Ball State did not have sufficient evidence to keep the evaluations from being disseminated.

In late November, the Daily News obtained access to the documents after submitting a freedom of information request citing Davis' advisory opinion.
