Deputy prosecutor won't answer questions about investigation

A representative of the Delaware County Prosecutor's office isrefusing to answer questions from the Daily News about theinvestigation into Michael McKinney's death.

The case presented to the prosecutor's office will be taken to agrand jury, according to a Star Press report from ThanksgivingBreak.

When J.A. Cummins, Chief Deputy Prosecutor was contacted forcomment by the Daily News he refused to offer, confirm ordeny any facts about the case.

"Everything I have to say was in a press release sent to theMuncie (Star Press) paper," Cummins said.

Cummins refused to send a copy of the press release to theDaily News. The Star Press was also unable to provide theDaily News with a copy of that press release.

According to a Ball State Daily News survey of studentmarketing demographics conducted in April 2003, 73 percent ofstudents read the Daily News three or more days per week.Thirteen percent of Ball State students read the Star Press threeor more days per week.

Delaware County Prosecutor Richard Reed did not return multiplemessages sent to him for comment Sunday evening.

Gene Burton, chief of University Police said the decision for agrand jury to review the case involving officer Robert Duplain isnot uncommon in a situation such as this.

"I anticipated and expected this in the process," Burtonsaid.
