Other non-lethal options were available to Officer Duplain, evenif he had not been informed of them. As a former Ball StateUniversity student and former Indiana Department of Correctionscorrections officer, I want to attest to the fact that OfficerDuplain did have less-than-lethal-force options available tohim.
Where was his baton? Where was his Maglite flashlight that couldhave been used as a baton to disable Mr. McKinney without takinghis life? I find it difficult to believe that an officer would gobehind a house at night in the dark without his flashlight but withhis gun drawn. I think that would constitute absolute negligence onthe part of the officer.
By allowing Officer Duplain on the street, riding alone onpatrol with a minimum amount of training and putting him in asituation where he was destined to fail, I personally feel that theUPD was negligent. I will say that my thoughts and prayers are withthe McKinney family. I encourage them to file a wrongful-death suitagainst the University Police Department because I think it wasinadequacies of departmental training that led to their son's deathat the hands of one of the UPD officers.
