DAYWATCH: Former student has hearing pushed back for third time

One reason it's a good idea to steer clear from trouble: not having to deal with the Delaware County Court system.

A former Ball State University student may find that out the hard way, even though she's fighting like mad to stay out of jail.

Ashley Kirkman, one of five then-Ball State students arrested on suspicion of attacking an Ivy Tech student last year, had her court hearing pushed back today to Feb. 12. The hearing was originally scheduled Oct. 22, but Kirkman's attorney's continuance was approved. This is the third time Kirkman's hearing has been pushed back. When it stops, nobody knows.

Kirkman was charged with battery resulting in serious bodily injury, a Class C felony with a standard prison sentence of two years. The three other women charged in the case - Amanda Polson, Kari Streib and Rene Whiteley - accepted plea bargains on Class D charges of criminal recklessness resulting in serious bodily injury. The only woman sentenced in the case so far, Polson, began serving a six-month sentence October in Delaware County Jail.
