Ball State professor will not face charges

A Ball State University professor involved in a collision in September that killed a Ball State student will not face charges, according to the Delaware County Prosecutor's Office.

The case had been under investigation, and the prosecutor determined early last week that there was no criminal intent on anyone's part.

The Sept 9. accident involved Kevin Smith, Department of History assistant chairman, and junior Joshua Hudson, a business administration major from Huntington.

The collision occurred when Hudson, 22, was traveling eastbound on Riverside Avenue on his motorcycle. Smith was stopped in his Ford Taurus on Riverside Avenue waiting to turn left onto Martin Street.

Smith failed to yield because he did not see Hudson's motorcycle. Hudson's motorcycle hit the right side of Smith's car. Hudson was not wearing a helmet.

Christopher Kirby of the Muncie Police Department's traffic enforcement unit said a reconstruction of the accident was submitted to the prosecutor's office Sept. 29. The office was then responsible for making the final decision on whether charges would be filed, he said.

Smith would not comment on the situation.
