Ball State students face possession, cultivating charges

Two Ball State University students were arrested Wednesday night after University Police Department officers caught them cultivating marijuana plants in their home near campus.

Freshman Michael Hurt, 20, and sophomore Adam Townsend, 21, both of 200 N. Meeks St., were arrested on charges of possession of marijuana and reckless possession of paraphernalia. Both are Class A misdemeanors. Hurt and Townsend were also arrested on charges of maintaining a common nuisance, a Class D felony.

Hurt and Townsend were taken to the Delaware County jail and booked with bail set at $12,500 each.

If found guilty on all charges, they could face a maximum of one year in prison and up to a $5,000 fine for each Class A misdemeanor and a maximum of one and a half years in prison and up to a $10,000 fine for the Class D felony, police said.

University Police said Hurt and Townsend have been under investigation for about one month. Police said neighbors made many complaints regarding illegal activities going on in Hurt and Townsend's house.

Illegal substances including marijuana, cocaine, acid and LSD are suspected to have been used in the residence, according to University Police reports.

The marijuana plants found in Hurt and Townsend's house were not yet fully matured, police reports said. Once matured, the plants could have been worth between $6,000 to $8,000. The plants' value depends on the kind of plant and the buds that come out.

Police said this incident is the first time in many months that UPD has seen any Ball State students involved in cultivating marijuana plants.
