Former Ball State student arrested for on-campus rape

A former Ball State student was arrested Wednesday after police say he raped a female in an on-campus residence hall last fall. 

Maxwell Charron, 19, of New Haven, Indiana, was arrested on a warrant by the Allen County Sheriff’s office and booked into jail Sunday.

He was transferred to the Delaware County Jail around 1 p.m. Wednesday.

Charron was charged with rape, a level 3 felony, and sexual battery, a level 6 felony in Delaware County Circuit Court 1 on March 22.

According to a probable cause affidavit from the Delaware County Prosecutor’s Office, Charron was in contact with a female student — who he met over the summer — on the night of Aug. 25. The female went to Charron’s room in the Johnson East Residence Hall to “hang out.”

The survivor told police both she and Charron were sick, so they took Nyquil — an over-the-counter cold and flu medication — before drinking alcohol. The two, along with Charron’s roommate, then went to a neighborhood near the residence hall and smoked marijuana. 

Charron had to help the survivor stand up, walk back to the residence hall and check in at the front desk because she was, “feeling dizzy and did not know what was going on.” 

When they got back to Charron’s room, he began to take off the female’s clothes, kiss and touch her, according to the probable cause affidavit. 

The survivor told investigators she told Charron to stop and pushed him off, but he continued. 

At one point, Charron choked the survivor, and recorded part of the incident on his cell phone. When the survivor questioned Charron about the video, he said he would delete it, then “laughed about it and said that not a lot of people would look at it.”

Senior media strategist Marc Ransford said Charron is no longer a student at Ball State. Charron was also trespassed from Ball State’s campus Feb. 14.

Charron was released from the Delaware County Jail Thursday afternoon after posting bail. 

He was also charged in Muncie City Court with criminal mischief in November 2017, and that case is still pending.

A pretrial conference is scheduled for Aug. 6 at 8:30 a.m. for the rape and sexual battery charges.
