Student death trial begins this month

Four years after the death of Ball State University student Michael McKinney, Robert Duplain will go to trial Jan. 22.

A representative from U.S. District Judge Richard Young's clerks office said McKinney vs. Duplain is a civil case instead of a criminal case because McKinney's family filed a lawsuit against Duplain and the university.

Young is presiding over the trial.

"They aren't going to find him guilty," the representative said, "but just whether they find liability to those two individuals. It is about money."

Jury selection is scheduled to start at 9 a.m. with the trial beginning about 1 p.m., said the representative. The trial is scheduled to last two weeks.
