Representative asks state police to intervene

Eric Koch, Tim McKinney's state representative, has asked theIndiana State Police to intervene in the investigation of MichaelMcKinney's death on behalf of the McKinney family, Tim McKinneysaid.

"I have no response from the State Police at this time," TimMcKinney said.

Maj. Larry Turner said he has not yet seen the letter, though itmight have been sent to Superintendent Melvin Carraway, who is inTexas.

McKinney announced a week ago that he would ask the State Policeto get involved because Delaware County and Muncie officials arenot answering his questions, and he thinks officer Robert Duplain,the man who killed his son, is being protected.

"I don't believe that there's even a remote possibility thatDuplain's going to have any criminal charges," McKinney said.

McKinney also said his family was not notified by Ball StateUniversity about the decision.

"We just really haven't had any contact from them since thecandlelight vigil," McKinney said.

J.A. Cummins, chief deputy prosecutor, will present the case toa grand jury.

Duplain is still planning on attending the Indiana PoliceAcademy, though he will have to wait for a decision by the grandjury, Gene Burton, director of public safety, said.
