Alcohol, drug arrests made

Ball State student, her boyfriend arrested Saturday at LaFollette.

A LaFollette resident and her boyfriend were arrested on drug and alcohol-related charges Saturday after University Police responded to a report of a domestic dispute at 3:29 a.m. at Mysch Hall.

According to police reports, Daniel J. Newbauer, 23, 523 E. S.R. 26, Frankfort, was arrested on charges of operating while intoxicated, resisting law enforcement, possession of marijuana, reckless possession of paraphernalia, leaving the scene of a property damage accident, public intoxication, disorderly conduct and two counts of possession of a controlled substance.

UPD arrested Newbauer's girlfriend, Suzanne M. Eller, 19, Mysch Hall Room 608, on charges of obstruction of justice, reckless possession of paraphernalia, public intoxication and minor consumption.

According to reports, Newbauer had been involved in an argument with his girlfriend and had struck a vehicle in parking lot R-2 with his GMC van before he was detained by Ball State security officer Vernon Cheetam.

When UPD officer David Bell arrived, he reported that Newbauer had poor balance, slurred speech and smelled of alcohol.

According to police reports, Bell then conducted an outer clothing search of Newbauer and found a pill container with two white pills and a powdery substance. Newbauer told police the powder was opium and the pills were Xanax.

Newbauer then admitted to striking a vehicle prior to parking his van, the report said.

Police then conducted a search of Newbauer's van and found marijuana. While officers were searching the vehicle, Eller arrived to retrieve her purse from the van.

Eller entered the vehicle and removed a glass pipe believed to contain marijuana residue from the floor board. She placed the pipe in her pocket and attempted to leave the scene.

Reports said officer Rebecca Baer witnessed Eller remove the pipe and throw it in the bushes. Baer then placed Eller under arrest.

Newbauer and Eller were taken to the Delaware County Jail where, according to reports, Newbauer failed various field sobriety tests and refused to take a chemical test.
